Commonwealth Fraud

The Commonwealth Criminal Code deals with various matters in relation to Fraud/Deception of the Commonwealth (Government) monies/properties for example;

  • Section.134.1(1) Criminal Code 1995 (Cth) makes it a criminal offence to dishonestly obtain Commonwealth property; and
  • Section 234.2(1) Criminal Code 1995 (Cth) makes it a criminal offence to obtain financial advantage by deception; and
  • Section.135.4(3) Criminal Code 1995 (Cth) makes it a criminal offence to dishonestly cause a loss to the Commonwealth.

Some examples of Commonwealth Fraud/Deception are:

  • Obtaining money from Centrelink dishonestly (by not telling them your true living/family circumstances and/or employment income); or
  • Accessing and obtaining a Commonwealth Grant when you know you do not qualify for it and have been dishonest in your application for one.

 

Maximum/Possible Penalties

Fraud/Deception of the Commonwealth can be punished with a prison sentence of up to 2 years (if heard in the Local Court) or up to 10 years (If heard in the District Court).

Please note these penalties are reserved for the worst kind of offending and are unlikely to be what you would receive.

In NSW, a court can impose any of the following penalties for a Tax Fraud charge.

  • Full time Imprisonment
  • Intensive Corrections Order (ICO)
  • Community Correction Order (CCO)
  • Conditional release Order (CRO) (ie: bond)

 

THE FACTS THAT MUST BE PROVEN

Since Fraud/Deception is a criminal offence, the burden of proof lies on the Prosecution.

The prosecution must prove:

  • That you have obtained that advantage/money by "deception"/dishonesty; and
  • That the person from whom the financial advantage has been obtained is a Commonwealth Entity/Agency.
