Soliciting Prostitution

In NSW, procuring a Person for Prostitution is an offence. Prostitution is inclusive of activities between persons of different sexes or of the same sex, and includes:

Sexual intercourse as defined in section 61H of the Crimes Act 1900 (NSW), and masturbation committed by one person on another.

 

THE LAW

The offence of Procuring a Person for Prostitution is contained in section 91A of the Crimes Act 1900 (NSW) which states:

“Whosoever procures, entices or leads away any person (not being a prostitute), whether with that person’s consent or not for purposes of prostitution, either within or without New South Wales, shall, notwithstanding that someone or more of the various acts constituting the offence may have been committed outside New South Wales, be liable to imprisonment for seven years”.

 

MAXIMUM/POSSIBLE PENALTIES

Soliciting Prostitution can be punished with imprisonment of up to 2 years (if heard in the Local Court) or up to 7 years (if heard in the District Court).

Please note these penalties are reserved for the worst kind of offending and are unlikely to be what you would receive.

In NSW, a court can impose any of the following penalties for a Soliciting Prostitution charge of:

  • Full-time Imprisonment;
  • An Intensive Corrections Order (ICO);
  • A Community Correction Order (CCO);
  • A Conditional Release Order (CRO).

 

THE FACTS THAT MUST BE PROVEN

To establish Soliciting Prostitution, the prosecution must prove the following matters beyond a reasonable doubt:

  • That you procured, enticed, or led away the victim; and
  • The victim was not a prostitute; and
  • That procurement was for the purposes of prostitution.

 

DEFENCES

Possible defences available for those charged with Soliciting Prostitution include:

  • If you were compelled to act in a certain way due to the circumstances, or the threats of another you may be able to argue “Duress”; or
  • If your actions were necessary to prevent a greater harm from occurring, you may have the defence of “Necessity”.
  • You did not do the act.
  • The person was a prostitute/sex worker.
