Speeding Offences

Police have the authority to suspend and take away your licence if you commit the following offences:

  • Speeding in excess of 45 km/h over the speed limit;
  • Speeding in excess of 30km/h over the speed limit whilst the holder of a learner or provisional license.

Your speed in excess over the speed limit will determine the period of your license suspension.

  • If you are travelling at more than 30 km/hr over the limit but under 45 km/hr, your license suspension period will be 3 months;
  • If you are travelling more than 45 km/hr over the limit, your license suspension period will be 6 months.

Other speeding offences: 

  • If found guilty other speeding offenses (lower speed than set out above) it will lead to an infringement per the Road Transport Act 2013 (NSW) which results in a fine and a loss of three demerit points.

 

OTHER POSSIBLE PENALTIES

In NSW, a court can impose any of the following penalties for a Speeding charge:

  • A Fine; and/or
  • A New Conditional Release Order (CRO).

 

THE FACTS THAT MUST BE PROVEN

There is a presumption in law that speeding cameras and Police or mobile or other devices are well functioning with utmost accuracy. If you want to dispute this presumption, you will have to prove otherwise in Court that the device was broken or tampered with, with the help of a professional.

 

DEFENCES

While building up a case against Speeding charges, the following defences can be put up in your favor:

  • If you act was propagated by some threats or some pressure you succumbed to, you may be able to argue “Duress”;
  • If it was inevitable to act in the way you did, and it was a wall against the occurrence of a bigger mishap/harm, you may have the defence of “Necessity”;
